Packaging for Apple's budget 'iPhone 5C' hits the web

This is typically the time of year when iPhone rumors really start heating up and it seems that 2013 is no exception. The latest on the Apple front comes in the form of an image recently posted on a Chinese discussion board which allegedly shows a bin full of plastic packaging for what most believe will be a budget iPhone.

The plastic shells look convincing enough but the real interesting part here is the name plastered on the side of the package: iPhone 5C. The writing is stylized such that it doesn?t fit Apple?s traditional naming convention but when you consider Apple?s upcoming redesign of iOS, the idea of a brand or logo change isn?t exactly out of the question.

Plastic packaging for an iPhone would be a first as well but it?s worth pointing out that the iPod touch is sold in a plastic shell. What the ?C? could stand for, however, is anyone?s guess at this point. Some believe the letter could stand for ?Color,? as the cheaper iPhone is rumored to be available in a number of different colors for the first time ever.

The only thing we know for certain about the next iPhone is that it will arrive with iOS 7 pre-installed. Described as the biggest change to the operating system since the introduction of the iPhone, the redesign comes courtesy of designer Jony Ive. It includes new icons, a new color pallet, revised fonts and the use of translucency throughout in addition to a number of other changes.

Feds investigate Redneck Day at Arizona high school, have nothing better to do

The U.S. Department of Education has officially opened an investigation into allegations that an Arizona high school?s campus-wide ?Redneck Day? amounted to a federal civil rights violation.

The kerfuffle giving rise to the investigation arose back in May at Queen Creek High School on the outskirts of Phoenix. The student council hatched a plan to energize students for prom week that included a faculty adviser-approved ?Redneck Day.?? The point was to dress like ?? and spoof ?? ?Duck Dynasty,? an A&E reality TV show which follows a wealthy, eccentric Louisiana family.

It?s not exactly clear how dressing like a hillbilly was going to motivate anyone for prom. What did happen, though, is that one kid bedecked himself in Confederate flag regalia, which offended some students. (RELATED: ?Redneck Day,? ?White Trash Wednesday? don?t go over so well at public schools)

In a July 18 missive to Reverend Jarrett Maupin II, the complainant, the Department?s Office for Civil Rights branch office in Denver details the status of the investigation.

?On May 23, 2013, we received your complaint alleging the Queen Creek Unified School District (District) discriminated on the basis of race,? the letter reads. ?Specifically, you allege that the District discriminated by creating a racially hostile environment at the ?redneck day? event on May 1, 2013, at Queen Creek High School and by failing to take action to correct the racially hostile environment.?

The racial hostility occurred apparently occurred because of one student who was wearing the Confederate flag?apparently like a cape. An assistant principal asked the student to remove the flag cape, which he did.

?It was no ill intent,? Tom Lindsey, superintendent of the Queen Creek Unified School District, told The Arizona Republic at the time.

Lindsey suggested that the Confederate flag-wearing student didn?t understand the problem at first because he had been transplant from an unnamed state where the Confederate flag is allegedly a more ordinary sight.

?We have determined that we have the authority to investigate this allegation,? the DOE letter also states. ?We note, however, that the display of the confederate flag concerns rights protected by the First Amendment of the United States Constitution. Therefore, the scope of OCR?s investigation will be limited to whether a racially hostile environment was created due to language and actions that were not protected by the First Amendment.?

As the Arizona Daily Independent notes, Maupin had been very displeased about the incident, claiming that he and many others were ?outraged over the controversial celebration.?

He was among a group of petitioners asking U.S. Secretary of Education Arne Duncan to intercede on behalf of any and all students ?negatively impacted by the racially-insensitive theme.?

The Daily Independent also recalls that Maupin, a former (very young) Phoenix mayoral candidate, was sentenced in 2009 to 75 hours of community service and five years of probation for making a false report to a local sheriff and the FBI.

Maupin?s tall tale involved a list of witnesses who had allegedly seen video evidence of then-Phoenix Mayor Phil Gordon committing unspecified crimes, reports The Arizona Republic.

The Phoenix New Times has described Maupin as Al Sharpton?s former Phoenix prot?g?.?

Minnesota Vikings?running back?Adrian Peterson?has heard all the chatter about his near record-breaking season after coming back from a devastating knee injury.

Peterson wants to silence the critics raising questions about how he came back so strong and welcomes being tested for human growth hormone to prove he is clean.

He also said that he is certain that NFL players are using HGH and wants the league to establish a testing program to start ?evening out the playing field.?

?You?ve got HGH, something that doesn?t show up on a test, and you?ve got guys out there trying to provide for their families,? Peterson was back on the field less than?nine months after his knee surgery. He capped off the season by rushing for 2,097 yards, 12 touchdowns and was named the league?s Most Valuable Player.

Jimmy Fallon talks new-fatherhood on 'Late Night'

NEW YORK (AP) ? It wasn't quite a royal proclamation, but Jimmy Fallon shared the name of his family's new addition: Winnie Rose.

Fallon joked in his "Late Night" monologue Wednesday that he hasn't had a chance to respond to everyone's messages, "but let me just say ? Yes, William and Kate, we'll definitely set up a play date."

Fallon and his film-producer wife, Nancy Juvonen Fallon, welcomed their daughter Tuesday morning.

The 38-year-old Fallon takes over NBC's "The Tonight Show" from Jay Leno next year after hosting "Late Night" since 2009.

Fallon thanked fans for their support on social networks and joked about chasing people down to show them pictures of his baby: "Now I understand why people are on Facebook. I get it now, I get it."

Jumpers and hurdlers form South Africa?s hopes for Moscow

Athletics South Africa has selected a team of 30 athletes to participate at the IAAF World Championships in Moscow from 10-18 August 2013.

Heading the team is former World indoor Long Lump champion and Olympic silver medallist Godfrey Mokoena, currently ranked sixth in the world for this year. His younger compatriot and national Long Jump champion, Zark Visser, is ranked seventh.

Lynique Prinsloo, ranked 10th in the world in the women?s Long Jump, will make her debut at the World Championships.

As has become customary, a full complement of men?s 400m Hurdlers have met the ?A? standard, with 2011 finalists LJ van Zyl and Cornel Fredericks being joined by PC Benecke. In the women?s400m Hurdles, Anneri Ebersohn was chosen over club-mate Wenda Nel Theron as Ebersohn is the national Champion. Both had achieved the ?B? standard, so only one could be selected.

It was the same case in the men?s Shot Put, where Orazio Cremona is chosen over Jaco Engelbrecht, as the selectors went with the national champion.

Sprint sensation and double World Student Games gold medallist Anaso Jobodwana has been included in the 100m and 200m. He is likely to be joined by the exciting new talent, Akani Simbine, who set a national junior 100m record in December last year.

Unfortunately, African 100m champion Simon Magakwe was not available for selection due to injury. Simbine will be confirmed in the team provided no other athlete achieves a faster ?B? standard before 28 July.

Andre Olivier, who has been showing great form in the IAAF Diamond League meetings this season, will line up in the 800m.

The team also includes national record-holders Johan Cronje in the 1500m, Willem Coertzen in the Decathlon, Lehann Fourie in the 110m Hurdles, Chris Harmse in the Hammer and Sunette Viljoen in the Javelin.

African Discus champion Victor Hogan and national 400m champion Wade van Niekerk complete the athletes who have achieved the ?A? qualifying standard.

World Student Games gold medallist Stephen Mokoka has achieved the ?B? standard in the 10,000m, joining Elroy Gelant (5000m), Robert Oosthuizen (Javelin) and Justine Palframan (200m) as athletes who will be added to the final team provided no-one achieves a better ?B? standard than them.

The marathon team is a mix of experience and youth, with national champion Cornelia Joubert joining Olympians Irvette van Zyl and Tanith Maxwell on the women?s team. Van Zyl joins her husband, LJ, in the team.

The men?s team includes former New York Marathon winner and multiple national record-holder Hendrick Ramaala. With Mokoka deciding to concentrate on the 10,000m, Ramaala is the second-fastest during the qualifying period. He is joined by Lusapho April and Sibusiso Nzima.

Two race walkers, Olympian Marc Mundell and Lebogang Shange, will take part in the 50km and 20km events respectively.

The final team will be confirmed on 29 July, giving athletes who have not yet qualified a last opportunity to do so.

Court refuses to revive military sex suit against Rumsfeld, Gates

RICHMOND, Va. (AP) ? A federal appeals court in Virginia has refused to revive a lawsuit against two former defense secretaries by 28 military members and veterans who said they were victims of sexual assault.

The unanimous decision Tuesday by a three-judge panel of the 4th U.S. Circuit Court of Appeals affirms a lower court's December 2011 ruling dismissing the case.?

The lawsuit alleged that former defense secretaries Donald Rumsfeld and Robert Gates fostered a culture that allowed rapists to thrive and punished victims for filing complaints against their attackers.

The appeals court acknowledged the severity of the allegations. However, the panel agreed with U.S. District Judge Liam O'Grady that the judiciary should not intervene in matters involving military discipline.

Rumsfeld was President George W. Bush's first defense secretary. Gates served under Bush and President Barack Obama.

Q&A: Microsoft Talks Changes to SkyDrive in Windows 8.1


When was the last time you had to delete a bunch of photos or apps on your mobile device to clear out space? With the massive amount of data generated every day, it's easy to exhaust all the available storage on your phone or tablet.

And this problem is only getting worse. Industry trends suggest that device storage capacities are growing at 25 percent per year, but the amount of data being produced is increasing even faster ? by around 50 percent a year, according to Microsoft. The software giant is looking to address this problem with SkyDrive, which will be updated in Windows 8.1 with the goal of giving you access to your files at all times, without taking up all your available storage or Internet bandwidth.

The updated service utilizes what Microsoft refers to as "placeholder files," which look and feel like normal folders and files with one major change ? you don't download the full file until you access it. The placeholder file contains just a thumbnail image and some basic properties, making it significantly smaller than its actual size. This means that 100GB of files in SkyDrive will use up less than 5GB of storage on the hard drive of your Windows 8.1 device, Mona Akmal, group program manager for SkyDrive apps, wrote in a blog post Monday.

"I have a Pictures folder in SkyDrive that's 5.6GB in size but it's only taking up 185MB on the local disk," Akmal wrote.

SkyDrive offline

Another major change to SkyDrive in Windows 8.1 deals with offline access to files. With the SkyDrive app, you'll now be able to mark any folders or files you want remain available when you lose Internet connectivity.

Any edits you make to a file while offline will automatically be synced back up to SkyDrive when you regain a connection. For added convenience, all the files you open or edit on your device will automatically be marked for offline access.

As a reminder, new SkyDrive users get 7GB of storage for free. After that, an additional 20GB costs $10 per year, while 50GB will set you back $25 a year, and 100GB costs $50 a year.

We sat down with Angus Logan, group product marketing manager for SkyDrive (pictured below), last week to get the scoop on the most important changes to the online storage service in Windows 8.1.

PCMag: What are some of the major changes to SkyDrive in Windows 8.1?
AL: In Windows 8.1 we've built SkyDrive right into the experience. You have one experience for accessing your files from the cloud, and also your local files from your device. This is especially important when you think about having hundreds of gigabytes of files available in the cloud, but maybe your local device only has 30GB of available storage. You can always have all of your files with you in a natural way.

PCMag: Which features do you think users will find most helpful in this version?
AL: The most exciting feature that consumers will love is being able to access all of their files all of the time, and select which files are available offline, and have them show up in search but then also have another set of files that are up in the cloud that they can access but won't take up the space on their hard drive.?

PCMag: How does SkyDrive differ from alternatives like iCloud, Google Drive, Box, and Dropbox?
AL: SkyDrive is really focused on being a comprehensive way to have all of your files with you no matter if that's a great set of photos, or a great set of Office documents. We really want you to be able to edit documents, see photos, and share this content no matter which device you're on. That means we're going to do an amazing job on Windows, but we'll also be available on lots of different devices.

If you look at the work we've done with Office and SkyDrive, you can save your Office documents straight up to the SkyDrive. That's just an example of how we've taken our personal cloud service and made it really easy for consumers to adopt through Office.

PCMag: Why would someone choose SkyDrive over these alternatives?
AL: If you use Windows, or you use Office, SkyDrive provides the richest set of features for you. We also don't compromise on other platforms. You can access your files on any different kind of device you have ? be that an iOS or Android device, but on Windows and in Office, SkyDrive is the best experience.

PCMag: Will SkyDrive kill online backup services like Mozy and Carbonite?
AL: There is definitely a place in the world for online backup services. Consumers who use SkyDrive know that ? I lose my device, and it doesn't really matter because I've got my files up in the cloud. We feel that there is a comfort level of having your data up in SkyDrive, but there is the niche for backup services, which will continue to exist.

PCMag: What would you say to those who don't trust the cloud, and are hesitant to put all their photos and documents in the hands of online storage services for either privacy or reliability reasons?
AL: The evolution of data living in the cloud has been going on for quite a while when you think about your email, or the people you interact with. Moving files to the cloud and having those available on your local computer but also on all your devices is just the next step of that evolution.

Microsoft takes privacy extremely seriously ? your data is your data. We don't read your data or scan it for advertising purposes.

Reliability is something we need to deliver, everyone needs to deliver it. But when you're talking about putting people's files up in the cloud so they can always have them, that is something that we take really quite seriously.

PCMag: What can we expect from SkyDrive going forward?
AL: We will continue to reach our aspirations of letting people always have their files with them no matter what device they're on and what kind of file that is. As for the future, I think you should go try out the Windows 8.1 preview because that is definitely ? it's the future.

Florida?s head of juvenile justice meets with protestors

The head of Florida?s juvenile justice department cleared her calendar Monday to meet with the young activists camped outside Gov. Rick Scott?s office.

Juvenile Justice Secretary Wansley Walters spent the morning and early afternoon fielding questions from the group ? and discussing the steps her agency is taking to prevent young people from entering the criminal justice system.

But the activists, known as the Dream Defenders, held firm on their pledge to stay in the Capitol until Scott convenes a special session of the Florida Legislature.

They want lawmakers to create a Trayvon Martin Civil Rights Act, which would repeal the controversial Stand Your Ground law, end racial profiling and remove zero tolerance policies from schools.

?We?re happy to engage in dialogue,? Dream Defenders co-founder Gabriel Pendas told Walters. ?But we don?t need any more talk. We need action.?

The Dream Defenders also blasted the governor for not holding a public event Sunday, despite calling for a statewide day of prayer and unity.

?It seems like the day of prayer was just lip service,? spokesman Steven Pargett said.

But Melissa Sellers, a spokeswoman for Scott, said the governor spent Sunday morning at Bible Based Church in Tallahassee.

?It was his personal time of worship,? she said.

Sellers said Scott participated in a conference call with 35 faith-based leaders on Friday.

He asked each to include a call for peace and unity in their Sunday sermons.

The Dream Defenders, a coalition of college students and young professionals from around the state, have spent the past seven days and six nights outside Scott?s office. Their sit-in demonstration is a response to George Zimmerman?s recent acquittal in the shooting death of Trayvon Martin, an unarmed black teenager.

Scott has made it clear that he will not convene a special session.

He directed Walters to speak with the group on Monday.

During an informal meeting outside Scott?s office, the student activists told Walters that ?zero tolerance? policies in schools were leading to too many suspensions and arrests.

Young people, they said, deserve second chances ? especially when one mistake might cause them to get tied up in the criminal justice system.

?I am not a supporter of zero tolerance,? Walters replied. ?I think when you work with kids, things should be handled on a case-by-case basis.?

The young activists also spoke out against incarcerating adults and children in the same facility.

?We need to change the culture,? Pendas said.

Walters said her department was working on solutions. ?Every day, we are working on the issues you are all talking about,? she said. ?I?d venture to say we?ve made more strides than any other state in the union.?

But the Dream Defenders wanted concrete action plans. So late Monday, they hunkered down for another night in the Capitol.

Google's bread and butter business declines


Google knows a thing or two about rapid shifts in technology usage. After all, the search giant has built its $300 billion market cap by effectively gutting the print world of its advertising dollars over the past decade.

So it is somewhat surprising - and a potential source of Schadenfreude for those whose livelihoods were Googled - to see the group led by Larry Page fumbling with a market transition of its own.

The Mountain View monopoly failed to live up to the expectations of its investors in the second quarter of the year.

Google reported earnings per share of $9.56, below the $10.83 that had been forecast by analysts polled by Thomson Reuters.

Revenues were light too, coming in at $14.1 billion instead of the $14.35 billion that had been anticipated. Though Google famously eschews giving guidance to Wall Street, this is a rare miss.

Barclays believes that the strength in Chinese refined production and draws in bonded and SHFE stocks is the cause behind this drive. And above all, the changes effected in import finance policy have the potential to boost imports and fuel apparent consumption.

?But how much of this increase in the apparent consumption numbers is driven by ?real? consumption at end-users?? Barclays asks.

It seems that power sector, especially, the grid sector is fuelling the consumption fire. Grid investments jumped 17% y/y in June compared to stagnation in May. No new projects of ultra-high voltage have been approved of. But it seems that the existing lines have reached a stage wherein new outlays are required.

?The gridcos were also investing in numerous smaller, distribution focused upgrades ahead of the summer peak season, and the state regulator urged them to be completed by the end of June, which could have led to a temporary boost,? Barclays report noted.

Given that Chinese consumption of home appliances is coming down, grid demand has become the bright spot in Chinese copper story.

Meanwhile, domestic stocks have been built up in China, thanks to months of strong copper inflows. However, copper imported for financing, this time around, has been cleared through customs rather than getting them parked in bonded warehouses. This was to take advantage of stronger prices and to avoid policy snags.

This would mean more of copper circulating in the domestic markets, taking a toll on apparent demand in the latter half of 2013.

Light aircraft travelling from London to France crashes into English Channel

An air-and-sea search by British and French rescuers investigating a light aircraft crash in the English Channel was expected to resume on Monday morning.

Fading light last night prompted authorities to call off attempts to find the missing pilot.

A cross-Channel search was launched after the American-registered plane carrying only one person came down about 15 miles off Dungeness in Kent at about 2.30pm on Sunday. The search and rescue operation involved both English and French teams, including a French helicopter and the Dungeness RNLI lifeboat.

The alarm was raised after authorities noticed the aircraft, which was heading from Blackbushe Airport in Hampshire to Le Touquet in France, was overdue, a spokesman for the Maritime and Coastguard Agency (MCA) said.

A French helicopter later found the wreckage of the aircraft, but the pilot had yet to be found. The MCA spokesman said: ?We had reports that an aircraft was overdue. It was heading from London to Le Touquet.

?The search has been involving a French helicopter and it has been searching for two hours.

?That will have to return shortly and that will be replaced by a search and rescue helicopter from RAF Wattisham in Suffolk. The Dungeness lifeboat is en route and we believe the Calais lifeboat is also involved. The search is ongoing at the moment to find the pilot.?

An Air Accidents Investigation Branch spokesman said: ?The AAIB have deployed a team to collect evidence and begin an initial investigation. The position of the aircraft will determine if the full investigation will be led by the AAIB or the French authorities.?

Andy Staples: Darius Robinson, current players become face of O'Bannon v. NCAA

Clemson CB No. 21 is now plaintiff No. 19 in a landmark lawsuit against the NCAA.

Thursday, six current college football players added their names to a group of 16 former college football and basketball players who have joined to sue the NCAA, video game maker EA Sports and the Collegiate Licensing Company. One of those current players was Clemson senior cornerback Darius Robinson, who sees a striking resemblance between himself and a certain senior cornerback at Clemson in the NCAA Football 14 game recently released by EA Sports.

"That's me all the way," Robinson said in an interview Thursday night after attorneys filed an amended complaint to the case, which is being tried in federal court in the Northern District of California. It's Robinson all right -- for better and for worse. "It's as close as it gets," he said. "Size, ratings. I don't have the best hands as a corner, so I always drop interceptions on the video game." And does he occasionally drop interceptions in real life? "Sometimes," Robinson said with a laugh. "I'm not going to lie."(There is one slight difference. Robinson, who wore No. 21 for three years, recently switched to No. 8. His Twitter handle remains @21FearGod.)

Now Robinson will join five other current players -- two from the Pac-12, two from the Big Ten and one from the SEC -- in the fight against the NCAA's model of amateurism, which holds that no matter how much revenue their teams bring in or how much that revenue increases over a period of years, athletes are entitled only to tuition, room and board as payment for their services. Robinson isn't ungrateful. He's thrilled to have a scholarship, but he has spent three years inside the machine, and he has learned a little about how the sausage is made for your Saturday enjoyment. "This is definitely something that I would love to get involved in," Robinson said, "because I really do believe in it."

Robinson's inspiration to join the suit came a few months ago when he learned the same lesson former Minnesota wrestler Joel Bauman learned earlier this year. When you're an athlete at an NCAA institution, your name and your face do not belong to you. Robinson wanted to get a job to earn extra money, but he couldn't work regular hours because of his commitment to the football team. So he sought work with more flexible hours. He hit upon 5LINX, a multilevel marketing company with a business model similar to Amway. While such companies certainly have their drawbacks, 5LINX does offer direct sales. In Robinson's case, he intended to sell mobile phones and phone plans.

MANDEL: Movement, but no ruling in class action certification hearing

Someone in Clemson's compliance department noticed an uptick in business-related posts on Robinson's Facebook and Instagram accounts, and Robinson was called in to meet with compliance officials. "According to the NCAA, the rule is that a student-athlete can have his own business," Robinson said. "But they were saying that I couldn't have it because I couldn't detach my name from it. They were saying I couldn't promote it. ... I didn't see a reason for me having a business if I couldn't promote it." Basically, Robinson wasn't allowed to use his name or face in connection to his business. This rule exists so boosters can't shuttle extra money to players for bogus products or services, but it also stops athletes from earning legitimate income under their own names. (On the NCAA's own website, you can find the tale of a Northwestern swimmer forced to use a pseudonym before she could self-publish a book.)

Robinson was incredulous. He pointed out that if he had time, he could go to work at a retail store selling mobile phones -- using his real name -- and not run afoul of NCAA rules. Why couldn't he do the same thing independently? Compliance officials, who were just doing their jobs and protecting Robinson's eligibility, told him he shouldn't risk NCAA trouble. So he dropped his business plans.

The episode made Robinson more interested in the inner workings of college athletics. He had seen stories about the huge new television contracts signed by various conferences -- including the ACC, of which Clemson is a member -- but he hadn't paid much attention. Of course he and his teammates had noticed someone was making money off a video game featuring their likenesses, but he hadn't thought much about it. That all changed after Robinson's run-in with compliance. "We need to be more educated about the entire process," Robinson said. "We really just know nothing."

Robinson wanted to make one thing clear to Clemson fans, though. This quest will not harm the Tigers on the field. The College Park, Ga., native, who came back from a fractured ankle to rejoin the first-team defense this spring, said his participation in the suit will not distract him from his role with a Clemson team that should be very good this fall. "It's something that I really believe in," he said. "But at the same time, I'm still focused on this upcoming season."

Robinson got himself hooked up with the plaintiffs' attorneys, who are led by Washington-based Michael Hausfeld. Hausfeld's team also signed up Arizona linebacker Jake Fischer, Arizona kicker Jake Smith, Vanderbilt linebacker Chase Garnham, Minnesota tight end Moses Alipate and Minnesota linebacker Victor Keise. Patrick Vint of SBNation pointed out that while Fischer, Garnham, Smith and Robinson are readily identifiable in the NCAA Football 2014 video game, Alipate and Keise do not have avatars in the game. In the amended complaint, plaintiffs' attorneys point out Alipate and Keise signed "one or more release forms." So the inclusion of the two Minnesota players may serve to challenge the name and likeness release forms Big Ten athletes are required to sign. In an interview Thursday, Hausfeld declined to discuss specific strategies. "We wanted to show the diversity of commitment in the different conferences, the different schools," Hausfeld said. "This is an issue that has caught their attention."

It took guts for the players to stand up to the NCAA, just as it takes guts for anyone who stands up to the establishment and asks for a better deal. But the players have plenty of support. The plaintiffs have a huge legal team that has sunk millions into this case because the attorneys see the NCAA and the schools and conferences that run major college sports as a poor man's Big Tobacco. The players also have support on campus. Fischer and Smith, for example, discussed their participation at length with Arizona football coach Rich Rodriguez and Wildcats athletic director Greg Byrne. "While we do not support the lawsuit, we support their right to be involved and express their opinion," Byrne said in a statement. "They are two fine young men and we are glad they are part of our program and university."

When the names of the players were released Thursday, the reaction was predictable. Critics on Twitter suggested they didn't buy the NCAA Football video game to play as Arizona's kicker or Vanderbilt's middle linebacker. But whether they realize it or not, they bought the game for the realism. There is a reason EA Sports employees spend valuable hours trying to match the size and speed attributes of backup tight ends on mid-tier Big 12 teams to their real-life counterparts. This is a business decision, an investment based on market research. The game sells better when it is as realistic as possible.

Another prong of the suit is television money. The rights to the games in which these athletes will play are sold for massive amounts. The Pac-12 has a 12-year, $3 billion deal with Fox and ESPN for select football and men's basketball games. Other games are broadcast on the Pac-12 Networks, which are sold to cable providers for a per-subscriber fee. All that money is redistributed to the schools, which will make millions more than they did a few years ago without giving a raise to the performers people are paying to see. The same is true of the SEC, which is in the middle of ESPN and CBS deals that will pay about $3 billion over 15 years. That figure will rise when the league and ESPN team to launch the SEC Network in 2014. The Big Ten, the Big 12 and the ACC also have big-money deals that dwarf what they made even 15 years ago.

Athletic directors, who have had no cap placed on their earnings as revenues have mushroomed, will argue that if the court forces more to players in the revenue sports (football and men's basketball), it will leave less money to support non-revenue sports such as volleyball, soccer and swimming. This is true, and a victory for the plaintiffs or a settlement might force schools to cut sports. This may sound insensitive, but what direct responsibility does a football player have to fund a swimmer's scholarship? None.

The players who joined the lawsuit Thursday will likely be long finished with their athletic careers by the time this case gets resolved. They're all seniors and they'll exhaust their eligibility before the scheduled trial date in 2014. If the case goes to trial, expect any verdict to be appealed all the way to the U.S. Supreme Court. That will take years. The players probably won't get rich individually even if they win, and they'll have to turn the other cheek to criticism from people who think athletes should just shut up and play ball.

In June, when Hausfeld said the plaintiffs would add at least one current athlete, I wrote that whoever joined the suit could be remembered as the Curt Flood of college sports. Flood, if you'll recall, faced mostly scorn and never reaped a financial benefit from his decision to challenge Major League Baseball's reserve clause. But generations of future professional athletes benefited from Flood's willingness to fight for a more reasonable split of the revenue between management and the labor force. These players will face criticism as well. But they might be the ones who pave the way for future generations of college football and basketball players to receive a larger share of the bounty they help create.

Canada?s Abel and Ware win bronze in three-metre synchro at aquatic worlds

Canadian divers Jennifer Abel and Pamela Ware earned bronze in the women?s three-metre synchronized springboard at the world championships on Saturday.

Abel, from Laval, Que., and Ware, a Beloeil, Que., native, scored 292.08 for Canada?s second medal at the event. Eric Hedlin of Victoria won Canada?s first with a silver in the men?s five-kilometre open water competition.

China?s Wu Minxia and Shi Tingmao took the three-metre gold, earning Wu a record sixth world title, while Italy?s Tania Cagnotto and Francesca Dallape claimed silver with 307.80.

Abel is a two-time Olympian who teamed with Emilie Heymans the last two seasons earning bronze at the 2012 Olympics and silver at the last worlds in 2011 in Shanghai.

This year, Abel and Ware have enjoyed success together winning three international medals and two Canadian titles.

?I don?t think we have come close yet to reaching our full potential,? said Abel. ?I think we showed today how strong we are mentally by never giving up. We have a similar style and show a lot of height and power on our dives. I?m excited about the future.?

The Canadian pair had a rough start and were in 10th place with two dives remaining. However they climbed to sixth in the fourth round and third after their fifth and final twisting dive earned them a string of 7.5?s and 8.0?s.

Ware said the early rounds just fired her up.

?I was pretty angry going into that fourth dive,? said the 20-year-old. ?I was so pleased we got it in and then we sealed it with a great last dive.?

The Chinese pair?s almost flawless execution of all five dives framed by the dramatic backdrop of Barcelona?s skyline gave them the top total score of 338.40 points.

Wu has won nine world or Olympic gold medals in the three-metre synchronized springboard. The only major title to escape her was the 2005 world championship when she didn?t compete in the event.

This was Wu?s first major competition with Shi, who won gold in the one-metre springboard at the 2011 worlds.

Oussama Mellouli of Tunisia clocked 53 minutes 30.4 seconds to win the men?s open water. Hedlin was 1.2 seconds behind, and five-time world champion Thomas Lurz of Germany finished third, 1.8 back.

?I am really happy because I didn?t expect (to beat Lurz),? Hedlin said. ?It felt pretty good. I was trying to hold a top position and stay in everyone?s draft. In the final sprint Oussama was so much quicker than me and I couldn?t do anything to beat him.?

Earlier, China?s Li Shixin topped the preliminaries in the men?s one-metre springboard.

Li, the defending one-metre springboard champion, led the men?s qualification for Monday?s final with 405 points, but a poor last dive let France?s Matthieu Rosset finish only 0.5 points behind.

Li looked ready to end the preliminaries with a commanding points difference until he missed with a three-and-a-half somersault pike on the sixth and final dive and barely edged Rosset for the top spot.

Illya Kvasha of Ukraine was third in qualifying, followed by Alejandro Chavez of Mexico in fourth and Sebastian Morales of Colombia in fifth.

Francois Imbeau-Dulac of St-Lazare, Que., placed 27th.

RISING RATES SPARK CAUTION ? Per Morgan Stanley analysts on the Business Conditions Index: ?The substantial pullback in the credit conditions index suggests that the sharp back-up in rates in the past couple months after the Fed signaled a sooner-than-expected start to QE tapering has led to a bit more near-term caution about the outlook. The composite index slipped 4 points to 57 percent in July on the pullback in the assessment of credit conditions and lower results for the hiring and capex gauges. The business conditions expectations index was one of the bright spots in the July survey, as businesses remained optimistic about a turn higher in growth in the second half. It ticked up 2 points to 71 percent after retreating in June.?

IRS HEARING PREP ? POLITICO?s Rachael Bade and Lauren French: ?J. Russell George isn?t used to being on the hot seat, but that?s likely to change on Thursday. A House Oversight and Government Reform Committee hearing on the IRS scandal will give Democrats an opportunity to slam the Treasury inspector general, who helped fuel anger at the agency after releasing a report in May that described unfair scrutiny being applied to tea party groups.

GLOBAL REGULATORS AT ODDS ? WSJ?s Michael R. Crittenden and David Enrich: ?Global regulators are pursuing disparate approaches to protecting the financial system against future shocks, fracturing an agreement forged in the wake of 2008 financial crisis to adopt a coordinated response. Policymakers ? are disagreeing over proper capital levels for banks, derivatives regulation, criminal prosecutions of bankers and even the appropriate forum for brokering agreement on financial-services issues. ? Countries like the U.S., U.K. and Switzerland are demanding that banks build thicker capital cushions to absorb losses and bigger liquidity buffers than most other European countries are embracing. LEW WARNS WALL STREET ? POLITICO?s Ben White: ?Treasury Secretary Jack Lew came to Wall Street on Wednesday and rejected financial industry arguments that the administration?s financial reform efforts are harming banks and slowing growth.

"?Dodd-Frank did not stifle economic growth. It did not halt lending activity. We are actually seeing just the opposite,? Lew said at the CNBC/Institutional Investor ?Delivering Alpha? conference at New York?s Pierre Hotel. ?Banks have more than doubled their capital on hand while achieving nine straight quarters of loan growth. And with Dodd-Frank signed into law, forward economic momentum has continued.?

?Lew, in his first major address to Wall Street, also said regulators would complete work by the end of the year on ?enhanced prudential standards for banks and designated nonbanks, capital and margin rules for derivatives, new simplified mortgage disclosure? and the Volcker rule. BERNANKE PLAYS DOWN IMPACT OF JOBLESS RATE ON PLANS ? WSJ?s Jon Hilsenrath and Victoria McGrane: ?Federal Reserve Chairman Ben Bernanke played down Wednesday the unemployment rate's weight in the central bank's calculation of when to start raising short-term borrowing costs, a fresh example of the challenge the Fed faces explaining its easy-money policies. ? Since last December, the Fed has been saying short-term interest rates ? now near zero ? won't go up at least until the jobless rate drops below 6.5 percent, and as long as inflation stays near 2 percent. But Mr. Bernanke suggested the Fed might keep rates near zero long after the jobless rate, which was 7.6 percent in June, falls below that 6.5 percent threshold. WATT HANDICAPPING ? Compass Point?s Isaac Boltansky: ?The Senate?s deal to avert the ?nuclear option? did not directly impact Rep. Watt?s nomination as it was not part of the broader deal and the agreement did not result in any changes to the rules for considering nominees. Therefore, Rep. Watt?s nomination still needs 60 votes in order to block a potential filibuster. Our current vote count ? continues to show Rep. Watt five votes shy of the 60-vote threshold.

?Still, while the ?nuclear option? did not directly impact Rep. Watt?s nomination, the agreement has more broadly impacted all executive nominations in the near-term. Following a day of digesting and discussing the ?nuclear option? deal, it is clear that Republican opposition to executive nominees has softened somewhat.
